H1-B VISA

For an educator/teacher to work in the United States of America, they need to have a work visa. Foreign nationals who intend to work in the USA need a H1-B Visa (work visa). The H1-B visa process is monitored by USCIS (United States Citizenship and Immigrations Services).

The H-1B is a visa in the United States under the Immigration and Nationality Act, that allows U.S. employers to employ foreign workers in specialty occupations. A specialty occupation requires the application of specialized knowledge and a bachelor's degree or the equivalent of work experience. The duration of stay is three years, extendable to six years, after which the visa holder can reapply. Laws limit the number of H-1B visas that are issued each year. There exist congressionally mandated caps limiting the number of H-1B visas that can be issued each fiscal year, which is 65,000 visas, and an additional 20,000 set aside for those graduating with master’s degrees or higher from a U.S. college or university. Only an employer must sponsor individuals/applicants for the H1-B visa.

BITS legal team will closely work with the United States Public US County schools and the applicant and provide assistance in the H1-B visa application and visa approval process. Once the H1-B visa of an applicant is approved, then BITS team will provide guidance and instructions to the applicant on how to obtain H1-B visa in their home country. The BITS Legal team will send the H1-B approval papers to the applicant, the applicant on receiving these papers will book an interview slot at the local US embassy in their home country and follow the due process of getting their H1-B VISA stamped on their passport.


NOTE: All applicants please check the passport validity dates in their passports. The passport should be valid at least 1 year from the date when the applicant submits the passport for H1-B visa stamping.
